European Court Of Human Rights Obliges Ukraine To Pay EUR 6,000 To Ukrainian For Improper Conditions Of Confinement

(Ukrainian News, Valeria Selezniova, 01/16/2012) The European Court of Human Rights obliges Ukraine to pay EUR 6,000 of compensation to a Ukrainian, Serhii Ustiantsev, 40, for moral damage due to improper conditions of confinement, Court's press service has said.

Respective ruling was passed at its hearing on January 12.

According to the report, Ustiantsev was judges for autotheft and has been imprisoned since 2003.

Ustiantsev complained of conditions of pretrial detention, which in his opinion humiliated human dignity.

He also complained of violation of right to personal complaint, as in the course of the investigation, he had no opportunity to make copies of case files, as his requests to copy them were ignored by prison administration.
The Court acknowledged the fact of improper conditions of confinement.
At the same time, the Court refused to admit violation of right to personal complaint.

As Ukrainian News earlier reported, the European Court of Human Rights obliged Ukraine to pay EUR 18,000 of compensation for moral damage to Ihor Todorov for prison's inappropriate medial observation.


European Court Of Human Rights Obliges Ukraine To Pay EUR 15,000 To Ukrainian For Improper Conditions Of Confinement

(Ukrainian News, Halyna Korba, 01/16/2012) The European Court of Human Rights has obliged Ukraine to pay EUR 15,000 of ,compensation to Ruslan Iglin, 31, for improper conditions of confinement before court proceedings, Court's press service has said.

The respective ruling was passed on January 12.

According to the report, at present, Iglin serves life imprisonment for a number of crimes including murder.

He complained of humiliation of his human dignity while detention from January 2004 to August 2006.

He also complained of refusal to provide him with additional time to study case file.

The Court acknowledged the fact of improper conditions of his detention and violation of his right to just trial.

European Court Of Human Rights Obliges Ukraine To Pay EUR 1,700 To Ukrainian For Excessively Long Arrest

(Ukrainian News, Halyna Korba, 01/16/2012) The European Court of Human Rights has obliged Ukraine to compensate EUR 1,700 for moral damage to a Ukrainian Serhii Borysenko, 44, due to excessively long detention during the pretrial investigation, Court's press service has said.

Respective ruling was passed by the Court on January 12.

According to the report, Borysenko has been judged for robbery and sentenced to seven years of imprisonment.

The Court acknowledged the fact of excessive length of pretrial detention of Borysenko and also violation of his right to freedom and safety.

As Ukrainian News earlier reported, on December 20, 2011, the European Court of Human Rights obliged Ukraine to pay EUR 20,000 of compensation for moral damage to Anatolii Teslenko, 37, for tortures during custody in police.

According to the report of the Committee of Ministers of the Council of Europe, in 2010, the European Court of Human Rights obliged Ukraine to compensate EUR 2,500 on its decisions as for claims of Ukrainian citizens on violation of their rights.

European Court Of Human Rights Obliges Ukraine To Pay EUR 18,000 To Ukrainian For Inappropriate Medical Service In Prison

(Ukrainian News, Halyna Korba, 01/16/2012) The European Court of Human Rights has obliged Ukraine to pay EUR 18,000 of compensation to a Ukrainian, Ihor Todorov, 46, for moral damage due to inappropriate medical services in prison, Court's press service has said.

Respective ruling was passed by the Court on January 12.

According to the report, Todorov suffered a number of diseases, including a serious disease of eyes.

He complained of losing sight after seven years in prison due to inappropriate medical service.

Todorov also complained of excessively long detention from August 1999 to November 2004 and of inability to have attorney while initial stage of investigative actions.

The Court also acknowledged facts of unsatisfactory medical service, excessively long pretrial detention and violation of right to just judicial proceedings.

As Ukrainian News earlier reported, the European Court of Human Rights has obliged Ukraine to pay EUR 8,000 of compensation for moral damage to Ihor Shevchenko for ineffective investigation into road accident that resulted in his disability.
