Millions of workers across Europe could benefit from new rights, says the ETUC, if the latest version of the platform directive is backed by member state governments. The Eurofound research agency has published a policy brief which underlines the need to tackle poor job quality among a range of essential occupations, including in the health and care, food systems, cleaning and refuse, transport and protective services sectors, along with manual workers in general. The report argues that these workers’ health and well-being were at risk during the COVID-19 pandemic and continue to be post-pandemic contributing to the labour shortages that persist in these sectors. The ETUC has welcomed the vote in the European Parliament’s Employment Committee to support legislation on workers in digital labour platforms. The ETUC says that delivery riders, cab drivers, content creators, programmers, click-workers, engineers and carers are among 28 million workers who would benefit from the provisions in the Employment Committee’s report. If passed as a directive it would mean an end to the system of false self-employment used by platform companies to cut costs at the detriment of workers’ pay and conditions, giving workers the right to a proper employment contract. Over the first six months of the years many of EPSU’s affiliates in health and social care have been active in negotiating, mobilising and taking action to secure improvements in pay and conditions for their members. With understaffing a major challenge across Europe, trade unions are fighting for the better, hours and other conditions that will help to retain staff and recruit more workers to these essential services. So far affiliates in 15 countries have been involved in protests, strikes and negotiations, with at least 16 new sector agreements delivering new pay and benefits for workers.

The ETUC says that the proposed directive on platform work should deliver rights to platform workers, like paid holiday and sick pay, which have been standard for other workers for the best part of a century. The directive provides the possibility to ensure that platform workers get a secure contract and guaranteed wages rather than the fake self-employment with no protection, no pay between jobs or sick pay. A new report by the Eurofound research organisation examines the long-term care sector and the challenges of low pay and difficult working conditions faced by workers, 80% of whom are women. On 29 April EPSU signed a landmark agreement with the French-based Korian social care multinational to set up a European works council (EWC). The agreement comes two years after EPSU took the initiative to bring together affiliates that organise in the company to form a network with a view to establishing an EWC. EPSU believes this is an important step in improving information and consultation in the company and sets the standard for other multinationals in the fast-growing social care sector.

The ETUC has published a report examining legal issues arising from new forms of employment. It hopes that it will make an important contribution to the debate around what action to take to provide protection for workers who fall outside the normal framework of labour and social legislation. The legal experts who compiled the report included a proposal for a new “personal work relation” that might help tackle these issues.

The ETUC has welcomed elements of the latest version of the draft Directive on Transparent and Predictable Working Conditions but is disappointed that some hoped-for rights, such as a ban on zero-hours contracts, have not materialised. It notes the new rights in relation to training, probation, payment for cancelled shifts and working for more than one employer. The ETUC was also calling for the right for precarious workers to transfer to more secure forms of employment and is disappointed that workers on fewer than 12 hours a month will be excluded. EPSU affiliates around Europe have been developing collective bargaining policies, using legal action and pushing for legislative change to help them address the persistent problem of low pay in sectors dominated by women. EPSU has made considerable progress in bringing together trade union representatives from across Europe in two social care multinationals - Orpea and Korian. Company networks are being built in both organisations while steps have already been taken in Orpea towards setting up a European works council, with the first meeting of the Special Negotiating Body taking place on 25 April. Both companies are French-owned and have expanded rapidly in recent years with subsidiaries now operating in several European countries.

The 2018 edition of the World Employment and Social Outlook from the International Labour Organisation has a generally positive analysis of unemployment trends in Europe but underlines the often poor quality of jobs being created which has also partly contributed to constraining wages. The report says that since the onset of the 2008 financial crisis, a large share of the jobs created, especially in the Euro Area, have been part-time jobs, and workers have often taken them involuntarily, owing to the lack of full-time employment opportunities.
