The FOA public service union has won a key court case that says that part-time workers who suffer injuries at work can have their compensation based on a full-time worker’s salary. The union has been pursuing this and similar cases on the basis that part-time work, particularly for many women workers, is only temporary, often coinciding with periods bringing up young children. Any injury compensation based on potential loss of earnings should therefore be based on the assumption that they would return to full-time employment.

The FOA public services union has won a case against a private care company that had cut certain parts of the salary package when 60 employees had transferred from the Bøgeskov municipal care centre in Aarhus. The tribunal made clear that various payments relating to evening, night and weekend work and increased holiday supplements should be protected in the transfer. Care workers win important legal victory
Seven care workers, supported by the Fagforbundet public services union, have won a significant court case that rules they were wrongly classified as self-employed and so were denied the rights of employees. The workers took the case against the Baos private care company and their claim covers the wide range of benefits and rights that they should have been entitled to under the Work Environment Act. The EIRO industrial relations observatory reports that enforced part-time work is a major problem in Sweden with 200,000 workers, 75% of them women, working fewer hours than they want to because of labour market conditions.
