The three public sector federations in the CCOO confederation (citizens' services, health and education) have submitted a case to the Audiencia Nacional high court in protest at the government's failure to negotiate pay increases for workers in the public sector. The right to negotiate is written into the basic statute for public sector workers and the government effectively ignored this last autumn when it said it would not negotiate over pay increases, having already made such a statement to the press. Meanwhile the FSP-UGT federation has also lodged a case against the Ministry of Health for signing collective agreements with unrepresentative nursing and professional organisations rather than the nationally recognised trade unions.

High Court opinion challenges pay cuts
The FSC-CCOO and FSP-UGT public service federations have welcomed a ruling by the High Court that the imposition of pay cuts may have contravened constitutional rights to freedom of association and collective bargaining. The case also raises issues of equal treatment as the pay cut was imposed at the Royal Mint but not in other public companies such as the RENFE rail firm. The particular legal challenge relates to employees of the Royal Spanish Mint but if the result is confirmed then it may well be applicable much more broadly across publicly owned companies and even across the public sector

The PCS civil service union has been taking industrial action over government changes to the civil service redundancy compensation scheme. However, it is also pursuing a case in the courts, arguing that the government had no right to make unilateral changes to the scheme as any amendments had to be negotiated and agreed with the trade unions.
