Court issues important ruling on the right to strike

In a case involving a Russian railworker who was dismissed after a one-day strike over pay, the European Court of Human Rights has confirmed that the right to strike falls under the protection of Article 11 of the European Convention on Human Rights as an important aspect of the right to freedom of association. The court based its arguments on conclusions of the International Labour Organisation's supervisory bodies, which take the right to strike as an indispensable corollary of the freedom of association.

Court rules against university’s anti-union actions

The Davar news website reports that last month the Regional Labour Court ordered Tel Aviv University to pay 150,000 shekels (€42,500) to the research laboratory workers’ union in compensation for obstructing its efforts to unionize. The Court said the university tried to fire the chair of the union and dock the salary of another union member. It ordered the university to rescind the dismissal of the union chair, Dr Moti Ronen, and bring him back to work under the same contractual agreements that preceded his dismissal. The university is also required to pay back in full the salary it docked

Important holiday pay ruling for union

The GPA-DJP services union has won an important court ruling clarifying that overtime should be included in the calculation of holiday and Christmas pay. The case was taken by the union in collaboration with the works council at the Caritas Socialis social care organisation. The outcome benefits not just the 850 employees at Caritas Socialis but around 120000 employees who are covered by the social care sector agreement. Important court victory against social dumping

The FNV Transport and Logistics trade union has won an important legal victory to ensure that Hungarian drivers working for the Dutch haulier Van den Bosch Transporten get the pay and conditions set by the sector agreement. The company had been using its Hungarian branch as a subcontractor with Hungarian drivers flown into the Netherlands to drive Hungarian vehicles and paid Hungarian wages. The European Transport Workers' Federation sees this as an important case, saying that the Posted Workers Directive is underused in the sector but can provide some protection against social dumping.
