There has been some improvement in industrial relations at the European Patent Office (EPO). As we reported in 2016 (November epsucob@NEWS 15) there had been considerable conflict in the organisation with several trade union representatives dismissed and who took up cases through the International Labour Organisation (ILO). The chair of the EPO union in Munich, Ion Brumme resumed his job in the middle of August, two and a half years after his dismissal. Both he and another colleague were cleared by an ILO tribunal. Brumme has urged the new EPO president to restore relations with the SUEPO

In a case involving a Russian railworker who was dismissed after a one-day strike over pay, the European Court of Human Rights has confirmed that the right to strike falls under the protection of Article 11 of the European Convention on Human Rights as an important aspect of the right to freedom of association. The court based its arguments on conclusions of the International Labour Organisation's supervisory bodies, which take the right to strike as an indispensable corollary of the freedom of association.

Low pay, understaffing, inadequate opportunities for training and career development, increasing administrative work and health and safety issues are among some of the main challenges facing workers in childcare according to new research commissioned by EPSU. On 6-7 June, EPSU is holding a second conference in Brussels in the context of its current project on quality employment and quality public services. Along with special sessions looking at the prisons and childcare sectors there will also be debates on pay trends in the public sector compared to the private sector; low pay in sectors dominated by women; young workers and quality employment; a panel on developments in collective bargaining and some initial research findings on the impact of digitalisation on the home care and public employment services.

EPSU is organising a conference on 6-7 June in Brussels that will explore a number of collective bargaining issues. Part of the conference will focus on quality employment and will discuss in particular research on quality employment in two sectors - prisons and childcare. Other sessions will debate new research commissioned by EPSU. This includes an updated analysis comparing pay trends in the public and private sectors; union action to tackle low pay in sectors dominated by women and the impact of digitalisation in home care and public employment services. The European Trade Union Institute has published an updated analysis of the treatment of social issues in the European Semester - the process of economic policy coordination. This reveals, for example, the extent to which the country-specific recommendations address the question of collective bargaining, with the European institutions calling for reforms in many countries, with the accent on decentralisation of bargaining despite the lack of evidence that this produces any economic benefits.

(May 2017) The revised labour code has been a major issue of debate in Lithuania for the last three years. The ETUI research organisation has just published a an update on this and other labour market, industral relations and pensions developments in the country. This is part of the ETUI's Reform Watch website covering all EU Member States.

(June 2017) The ETF European federation for transport workers has reacted angrily to recommendatoins from the European Commission in its "Open and connected Europe" document on the so-called service continuity, including measures affecting the right to strike of air traffic control staff. The federation believes the measures infringe the EU Charter of Fundamental Rights and says it reserves the right to challenge them in the European Court of Justice. On 20 December the European Commission published is draft directive on transparent and predictable working conditions to replace the Written Statement Directive. The initial response from the ETUC is to welcome the requirement on employers to provide information to workers on day one and to extend this right to a range of atypical workers. There are also positive measures related to training, prohibition periods, protection of trade union reps and the rights of flexible workers. Unions organising childcare workers met in Brussels to exchange information on some of the main challenges they face to improve the quality of employment in the sector. Low pay, undervaluing of childcare work, precarious employment, work intensification, health and safety, staff shortages and inadequate career development were among the issues facing many unions in the sector.

With hundreds of thousands of public service workers taking strike action across Europe in recent weeks - in Belgium, France, Italy, Portugal, the UK, Austria and Germany - it is timely that EPSU is publishing factsheets on the right to strike in 35 countries. The factsheets have been produced for EPSU by the European Trade Union Institute. Some groups of public service workers often face bans or restrictions on their right to strike and these factsheets set out the main rules. The ETUC is calling on the European institutions to swiftly adopt the agreement on setting up a European Labour Authority (ELA). The ETUC believes the ELA will strengthen workers’ rights by helping national authorities apply and enforce European labour law and to fight abuses in labour mobility, social security and the posting of workers. The Authority will also have a role in providing information to workers and employers on their rights and obligations, coordinate and support inspections and facilitate cooperation between Member States in applying and enforcing EU law.

The SUEPO trade union, representing staff at the European Patent Office (EPO), says that it will take strike action in June unless management responds to a series of key demands on fair pay and fair treatment of workers. There had been a very difficult industrial relations climate at EPO for some time but with the appointment of a new president last year there was some hope for an improvement. However, a recent staff survey reveals continuing problems and more or less a continuation of the hardline management of the old regime. The latest report on global trade union rights from the International Trade Union Confederation (ITUC) reveals a deterioration of workers’ rights across the world. The greatest increase in cases where workers were denied the right to establish or join a trade union was experienced in Europe where 50% of countries now exclude groups of workers, up from 20% in 2018. The report also highlights the fact that “Europe, traditionally the mainstay of collective bargaining rights, saw companies in Estonia, the Netherlands, Norway and Spain seek to undermine or circumvent workers’ rights.”
